A Practical Approach to Legal Advice and Drafting offers practical help; explaining how a practising lawyer should approach advising a client, preparing a case and drafting documents. Throughout, the author includes all the appropriate statutory rules and rules of court which are accepted in practice.
In this fourth edition, the sections on the practical skills of a lawyer have been greatly extended and the book includes checklists, hints and drafting examples.
The main chapters of the book deal with the lawyer as a professional adviser; the first interview with the client; the brief to counsel; the opinion; advising in conference; investigation and preparation of a case: basic principles of drafting and pleading: the writ and statement of claim; drafting other pleadings in a writ action: preparing the case for court: the originating summons action; drafting affidavits; settling an action; advising and drafting for civil appeals; advising and drafting for county court actions; advising and drafting in criminal cases.
The last section of the book gives a number of more specific examples of the most important types of draft for the main areas of law such as contract, tort, trusts, criminal law and family law.
About the Author: Susan Blake spent several years in general practice at the Bar dealing with a variety of types of cases in all levels of courts, as well as preparing opinions and drafting for more senior barristers. She is now a Reader at the Inns of Court School of Law.
